1.1. This public offer contains all the existing terms and conditions for organizing purchase and sale via the Internet, between the person making the purchase (hereinafter referred to as the "buyer") and the online store "www.shops-usa.com" (hereinafter referred to as the "seller"), jointly referred to as the "Parties". The online store is registered under "E-CONSULTING Ltd." with registration number 207456453. Further terms and conditions of the public offer are the same without exception for all visitors to the online store www.shops-usa.com, regardless of status (individuals and legal entities), who have the intention, desire and ability to purchase the offered goods.
1.2. This public offer defines the terms and conditions for purchasing items from the Store Catalog, hereinafter referred to as the "Goods", by the Buyer through the Seller's online store.
1.3. The acceptance of the terms of this offer (acceptance) is the conclusion of a transaction on the proposed terms, which is confirmed by the fact that the Buyer has paid for the goods ordered on the website of the online store (or in another way).
1.4. In this offer, unless the context otherwise requires, the following terms have the following meanings:

“Online store” – the Seller’s website created for the conclusion of a retail sale and purchase, after the Buyer has familiarized himself with the Seller’s offered Goods in photographs remotely.
“Seller” – an organization, regardless of its organizational and legal form and/or an individual entrepreneur selling the goods.
“Product” – products offered for sale and posted in the Catalog on the website www.shops-usa.com.
“Buyer” – an individual and/or legal entity placing an order on the website www.shops-usa.com.
“Delivery Service” – a Company engaged by the seller and the buyer to deliver the Product.
“Acceptance” – the Buyer’s full and unconditional acceptance of the terms and conditions of the public offer.
“Order” – individual items from the product range specified by the Buyer when placing an order on the website.
“Operator” – a representative of shopsusa.ru who answers telephone calls from customers.
“Catalog” – The range of products available on the shopsusa.ru website.
2.1. The Buyer independently places an Order on the website by adding the Product to the tab. “Cart” and fills in the relevant Order form, specifies the payment method, and selects the option “Place Order” or verbally by telephone using the numbers listed on the website, after reviewing this offer.
2.2. Payment methods (including prepayment requirements) and delivery methods may vary depending on the selected product.
2.3. The Buyer may receive the Goods by courier delivery or pick up the Goods independently at the post office.
2.4. An order is considered to be placed and accepted for execution if:

2.4.2. The Buyer placed an Order for Goods by telephone or via messenger, and the Operator informed the Buyer that the Order had been accepted for fulfillment.
2.4.3 If the Operator does not confirm acceptance of the Order, or the Buyer refuses to place the Order, such Order shall be deemed not placed and shall not be subject to execution.
3.1. In accordance with Article 25 of the Law of the Russian Federation “On Protection of Consumer Rights,” the Buyer has the right to exchange Goods of good quality within fourteen days, not counting the day of purchase, unless a longer period is announced by the Seller. The Buyer has the right to exchange the Goods, subject to the provisions of the legislation on the grounds and list of Goods that are not subject to exchange (return).
3.2. If the Buyer intends to return the Goods, such return shall be carried out in accordance with the rules and conditions of the carrier or courier operating in the Russian Federation or in another country, depending on the place of receipt of the Goods.
3.3. In the event of a defect in the goods, the Buyer is obliged to record it in a report of any form. The report must be signed by the Buyer and the person delivering the Goods. The defect must be recorded by video. The Buyer is obliged to notify the Seller of any defects in the Goods on the day of receipt of the parcel by filling out a complaint form for the return of the Goods on the website shopsusa.ru.
3.4. The Parties agree that in case of non-compliance with the mandatory requirements of the specified procedure, the Goods shall be recognized by the Buyer as being in proper condition – without any mechanical damage and complete.
4.1. The Seller guarantees the confidentiality of the information provided by the Buyer during registration or when placing an order.
4.2. The Seller guarantees that personal data will not be used for selfish purposes, on third-party resources, or for distributing spam.
4.3. When placing an order, the Buyer consents to the processing of their personal data, which is stored in the Seller's database solely for the purpose of identifying the Buyer/Recipient for repeat orders and for the correct execution thereof. If the Buyer refuses, the Seller will not be able to process the order accordingly.
5.1. After Acceptance, the Seller shall be obliged to comply with the terms and conditions of this Offer.
5.2. The Seller shall deliver the Goods to the Buyer in accordance with the selected sample on the relevant page of the shopsusa.ru website, the completed order, and the terms and conditions of this Offer.
5.3. The Seller shall have the right to unilaterally suspend the provision of services under this Offer in the event of a breach by the Buyer of the terms and conditions of this Offer.
5.4 All objects available on the shopsusa.ru website, including design elements, text, graphic images, illustrations, videos, computer programs, databases, and any content posted on the Sites' services, are the exclusive property of the Seller and other rights holders.
5.5. The Buyer shall pay for the Goods in a timely manner in accordance with the terms of this Offer.
5.6 The Buyer is obliged to familiarize themselves with the information about the Goods posted on the Seller's website.
5.7 Upon receipt of the Goods, the Buyer shall, in the presence of a representative of the Delivery Service, verify the integrity and completeness of the Goods by inspecting the factory packaging. If the factory packaging is damaged or the Goods are incomplete, this shall be recorded in a report, which shall be signed by the Buyer and the representative of the Delivery Service.
5.8 The buyer is obliged not to take any actions that may lead to a disproportionately large load on the infrastructure of the shopsusa.ru website.
5.9 The Parties shall be liable for failure to perform or improper performance of their obligations under this Offer, its Acceptance, and the applicable laws of the Russian Federation.
5.10 In the event of disputes arising in connection with the performance of obligations by the Parties, except for disputes concerning the collection of debts from the Buyer, the Parties undertake to resolve them through negotiations in accordance with the claims procedure. The period for consideration of a claim shall be 5 (five) business days from the date of its receipt. In disputes related to the collection of debts from the Buyer, compliance with the claims procedure is not required.
